Bushfire variations for Bunnings given green light at SAT
BDG’s Associate Director, Mark Szabo, provided expert testimony in a successful appeal against the rigid application of bushfire risk management policy in the SAT.
Acting for Bunnings, and alongside Lavan Legal and Bushfire Prone Planning, Mark successfully argued that the application of policy must always consider context and the individual merit of a proposal.
In its ruling, the Tribunal found the proposal to be of ‘sound basis’ and ‘clearly grounded in the planning principles established by the intent and objectives of the policy’.
This demonstrates the value BDG’s team places on possessing both an in-depth understanding of the technical aspects of policy, and the perspective to know when and how to vary them.
